Introduction- Important Sections of CrPC 1973

The Code of Criminal Procedure, 1973 is a procedural or adjective law that has been passed by Parliament to provide for the procedures for criminal prosecution. It provides for the procedure applicable to all criminal proceedings in India except in Nagaland and Tribal areas in Assam. There are two types of laws governing the applicability of laws:

1. Procedural or Adjective Law
2. Substantive and ………….. Law

Procedural Laws:

Procedural Laws deal with the matters relating to the applicable procedures to be followed in criminal proceedings. Its applicability starts with the inception of the crime committed and sometimes before its commitment. It includes the procedure for making arrests by the police officers, the institution of criminal proceeding, filing of FIR, commencement of trial, methods of taking evidence, arguments, judgment, etc.

Substantive Law:

Substantive laws are that type of law which deals with the substantive rights and duties of a person. It is in the nature of determining the substantive rights and liabilities of a person.

1. State Govt- appoint a session cort for every sessions divisions
2. Judge to be appointed by the High Court
3. High court may – Additional sessions judge & assistant session judges to exercise jurisdiction in a court of session.

Section 10 – Subordination of Assistant Sessions Judges.

Section 11 – Judicial Magistrate Court

Section 12 – CJM & ACJM – chief judicial Magistrate and Addnl. Chief Judicial Magistrate.
